These Terms of Service ("Terms") are a contract between you and Subvibly ("we", "us", "our") for your use of the Subvibly website, web app, and browser extension (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
1. Who operates the Service
Subvibly is currently operated as an independent software project. If we form a company or assign the Service to another entity, we will update these Terms and identify the new operator.
2. Eligibility
You must be old enough to consent to online services in your country (at least 13 years old). If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian. You may not use the Service if you are barred from doing so under applicable law.
3. What Subvibly does
Subvibly is a language-learning tool that works with online videos. It provides captions, word lookups, translations, saved vocabulary, practice features, progress tracking, and AI-assisted coaching. Features may change, be added, or be removed over time. Some features require a paid "Pro" plan.
Subvibly does not host video content. When you open a video, you interact with third-party platforms (such as YouTube) under their own terms and policies.
4. Accounts and local data
- You may use parts of the Service without signing in. Data may be stored locally in your browser on that device.
- If you create an account, we may sync learning data across devices through our cloud providers when you are signed in.
- Sign-in may be offered through email or third-party identity providers (such as Google, Apple, Facebook, or Telegram) via our authentication partner.
- You are responsible for activity on your account and for keeping access credentials secure.
- You may delete your profile from the app settings. Deletion removes local data on that device and, when cloud sync is enabled, we will delete or stop syncing associated cloud records except where retention is required by law or for billing disputes.
5. Pro plans, trials, and billing
- Pro features may include dictionary tools, practice modes, progress analytics, AI Coach, and other capabilities marked as Pro in the app.
- Paid subscriptions are processed by Stripe. We do not store your full payment card number on our servers.
- Unless stated otherwise at checkout, new subscriptions may include a free trial (currently 7 days). If you do not cancel before the trial ends, your payment method may be charged for the plan you selected.
- Current list prices are shown in the app before checkout (for example, monthly, quarterly, or yearly plans in USD). Taxes may apply depending on your location.
- You can cancel a subscription through the billing portal linked from the app or through Stripe, depending on what we expose in your account. Cancellation stops future charges; access generally continues until the end of the paid period.
- Unless required by applicable law, fees are non-refundable once a billing period has started. Nothing in these Terms limits mandatory refund rights you may have as a consumer.
- Promotional or access codes may grant discounts or temporary Pro access. Codes may be limited, revoked, or changed at any time.
6. Acceptable use
You agree not to:
- use the Service for unlawful, harmful, or abusive purposes;
- attempt to probe, scan, overload, scrape, or reverse engineer the Service except where permitted by law;
- circumvent access controls, rate limits, or Pro restrictions, including by sharing accounts or abusing promo codes;
- use automated means to extract content or to send excessive requests to our APIs;
- infringe intellectual property or privacy rights of others, including by misusing video content or captions;
- upload malware or interfere with the operation of the Service.
We may suspend or terminate access if we reasonably believe you violated these Terms or pose a risk to the Service or other users.
7. AI and learning content
Parts of the Service use automated systems (including third-party AI models) for translations, word explanations, coaching chat, and pronunciation feedback. AI output may be inaccurate, incomplete, or inappropriate. It is for language practice only and is not professional, legal, medical, or other expert advice. You are responsible for how you use AI-generated content.
8. Third-party services
The Service relies on third parties such as video platforms, authentication providers, payment processors, hosting providers, translation services, and AI APIs. Your use of those services may be subject to their separate terms and privacy policies. We do not control third-party content, availability, or policies.
9. Intellectual property
We and our licensors own the Service, including software, branding, and design, except for content you provide or third-party materials. You retain ownership of content you submit (such as saved words and chat messages). You grant us a limited license to host, process, and display that content solely to operate and improve the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT USING IT WILL PRODUCE ANY SPECIFIC LEARNING RESULT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Termination
You may stop using the Service at any time. We may suspend or terminate the Service or your access with notice when reasonable, or immediately for serious violations or legal requirements. Sections that by nature should survive (including disclaimers, liability limits, and governing law) will survive termination.
13. Governing law
These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise.
14. Changes
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, in the app or by email if we have it). Continued use after the effective date means you accept the updated Terms.
